• All sales are final. One complimentary revision is typically included; additional revisions may incur fees.

• If a client goes silent or deliberately delays communication beyond a reasonable time, we may process the remaining project balance automatically to protect our team’s reserved time and work.

• We may showcase completed work in our portfolio unless otherwise agreed in writing.

• We reserve the right to refuse service based on ethical or religious grounds.

Legal Terms

Scope of Agreement

These Terms of Service (“Terms”) govern your use of the websites and services operated by Golden Medina Services, LLC (“GMS Partners,” “we,” “our,” or “us”), including but not limited to:

By accessing our websites or engaging our services, you agree to be bound by these Terms.

Privacy

Your use of our websites is subject to our Privacy Policy. This policy explains how we collect, use, and safeguard your information.

Electronic Communications

By visiting our websites or communicating with us electronically, you consent to receive communications electronically. You agree that such communications satisfy any legal requirement that they be in writing.

Your Account

If you create an account on our websites, you are responsible for maintaining its confidentiality and for all activities under your account. We reserve the right to refuse or terminate accounts at our discretion.

Creative Agreement & Rights to Work

1. Ownership & License

   • All creative assets (raw footage, design files, concepts, and deliverables) remain the property of GMS Partners unless otherwise agreed in writing.

   • Upon full payment, clients are granted a standard usage license:

     • Non-exclusive, non-transferable, worldwide, perpetual use of final deliverables for business/marketing purposes.
       
       

2. Portfolio & Promotional Use

   • We may display completed work (final edited deliverables) in our portfolio, website, social media, or marketing, unless otherwise agreed in writing.
     
     

3. Exclusive Rights

   • Must be requested and agreed upon before production begins.

   • Requires purchase of an exclusive-use license with defined scope, duration, and fees.

   • Exclusive rights cannot be granted retroactively.
     
     

4. Third-Party Use

   • Clients may not sell, sublicense, or transfer creative assets to third parties without written consent.
     
     

5. Acknowledgment

   • By engaging with our services, you accept this Creative Agreement automatically.

Use of Artificial Intelligence, Likeness, and Creative Systems

Golden Medina Services, LLC (“GMS Partners”) utilizes a combination of traditional creative techniques and modern, AI-assisted tools to support editing, production, quality control, and workflow efficiency.

By engaging our services, clients acknowledge and agree to the following:

Adult Client Likeness and Creative Use

For adult clients (18 years or older), images, video, audio, and likeness may be processed through internal systems, including AI-assisted tools, for purposes such as editing, enhancement, color correction, quality control, creative iteration, and operational improvement.

Where appropriate and at our discretion, work created for adult clients may also be used:

• For internal system optimization and creative learning

• For portfolio, case study, or promotional purposes

• To inform future creative standards and workflows

GMS Partners does not sell client likenesses or personal data to third parties.

Minors Appearing in Client Projects

While our services are intended for adults, clients may occasionally request the inclusion of children or other minors in photography or video projects.

By agreeing to include a minor in any project, the client affirms that they are the parent or legal guardian of the minor, or that they have obtained proper legal consent to authorize the minor’s participation.

The likeness of minors may be processed only for functional and technical purposes, including:

• Image recognition for editing and retouching

• Basic enhancement or correction

• Identifying lighting, composition, or surface-level imperfections
  
  

Minors’ likenesses are not used to:

• Create AI characters, avatars, or synthetic representations

• Train generative likeness or identity models

• Appear in marketing, portfolio, or promotional materials without separate, explicit written consent

AI Characters, Avatars, and Synthetic Content

From time to time, GMS Partners may create AI-generated characters, avatars, or synthetic visuals for conceptual, illustrative, or marketing purposes.

These AI-generated characters are original creations and are not intended to represent real individuals.

Any resemblance to actual persons, living or deceased, is purely coincidental and unintentional. AI-generated characters are not designed to replicate, impersonate, or substitute any specific client or individual.

Data Stewardship and Security

GMS Partners utilizes established software platforms and maintains internal controls for handling creative assets. Client materials are treated as proprietary and confidential.

While no system can guarantee absolute security, reasonable and appropriate measures are taken to safeguard client imagery, likeness, and data throughout our workflows.

Right to Refuse Service

We reserve the right to decline or terminate service if a client’s content or business conflicts with our ethical or religious values. This includes but is not limited to: illegal activities, discriminatory practices, hate speech, deceptive practices, or content contrary to our conservative religious beliefs.

Children Under 18

Our services are intended for individuals 18 years or older. We do not knowingly collect personal data from minors for independent use.

Minors may appear in photography or video projects only when included by a parent or legal guardian, and only as outlined in the “Use of Artificial Intelligence, Likeness, and Creative Systems” section of these Terms.

Cancellation, Revisions & Refund Policy

• Cancellations by Client: All deposits and payments are non-refundable. If cancellation occurs after work begins, client remains responsible for completed work.

• Cancellations by GMS Partners: We may cancel due to conflicts of interest, violations, or unforeseen issues; unused deposits may be refunded at our discretion.

• Revisions: One complimentary round of revisions is included unless otherwise specified. Additional or major revisions may incur fees.

• Refunds: All sales are final. No refunds once work has commenced or deliverables provided.

• Project Pauses: If client delays or becomes unresponsive for more than 14–30 days, the project may be marked abandoned and subject to restart fees or automatic payment processing as outlined below.

Payment Responsibility & Deliberate Delays

Clients agree to maintain timely communication throughout all stages of their project. Feedback, approvals, and deliverables are expected to follow the estimated timeline discussed at project initiation.

If a client deliberately delays communication, feedback, or approval to stall a project beyond a reasonable timeframe (as determined by Golden Medina Services based on standard completion estimates), Golden Medina Services reserves the right to initiate payment processing for any remaining project balance using the payment method(s) provided at the time of booking.

This includes, but is not limited to, situations where:

• The project could have been completed within the originally estimated timeframe had communication been maintained.

• The client becomes unresponsive for an extended period (14+ days) despite multiple contact attempts.

• The client attempts to postpone payment under the pretense of pending feedback, revisions, or reviews.
  
  

By engaging our services, clients acknowledge that non-communication or intentional delay constitutes acceptance of completed work-to-date and authorizes Golden Medina Services to process outstanding balances in order to compensate the production team for time and resources reserved.

Once payment is processed, editing or revisions may continue at the client’s convenience, subject to normal turnaround times.

Links to Third-Party Sites

We are not responsible for the content of third-party websites linked from ours.

Intellectual Property

You are granted a limited license to use our websites. Content on our sites is protected and may not be modified, resold, or exploited without permission.

International Users

If you access our services outside the USA, you are responsible for compliance with local laws.

Indemnification

You agree to indemnify and hold harmless GMS Partners from claims arising from your use of our services.

Arbitration & Governing Law

• Disputes shall be resolved by binding arbitration under the Federal Arbitration Act.

• Venue is Clark County, Nevada.

• Class actions are not permitted.
  
  

Liability Disclaimer

Services are provided “as is” without warranties. We are not liable for indirect, incidental, or consequential damages.

Termination of Services

We may suspend or terminate your account or project for violation of these Terms or non-payment.

Changes to Terms

We reserve the right to update these Terms at any time. Updates will be posted on this page with a revised “last updated” date.

Entire Agreement

These Terms, along with any project-specific agreements, Privacy Policy, and Creative Agreement, form the entire agreement between you and Golden Medina Services, LLC.
